Terms and Conditions

1. Image editing

Professional editing of the best images (colour and brightness adjustments, contrast, cropping) is included in the price. Extensive retouching (e.g. skin retouching) is available by arrangement and at an additional cost.

2. Number of images

There is no limit – all successful, selected images will be delivered to the couple as the final set.

3. Delivery of the files

For wedding reportages of 8 hours or more, the couple will also receive the edited images on a free USB stick. A password-protected online gallery will be provided for guests to view and download.

4. Booking and payment

A binding reservation of the wedding date is only made once a deposit/date reservation fee of 50% of the total amount has been received. The remaining balance is due after the wedding, but before the final delivery of the images. If no deposit is received within 7 days of signing the contract, an administration fee of CHF 250.– will be charged.

5. Price guarantee

There are no hidden costs, provided the booked scope of services is not extended at the couple’s request.

6. Cancellation by the couple

If the wedding is cancelled by the couple, any entitlement to a refund of the date reservation fee paid is forfeited. In this case, we recommend taking out wedding insurance.

7. Schedule on the wedding day

The couple ensures that all involved persons are on time and that relevant details (bouquet, rings, decorations) are ready in good time. CUBU PHOTOGRAPHY GMBH is granted unrestricted access to all relevant locations. A photo timeline will be created in advance and serves as a guideline.

8. Restrictions by third parties

If photography is restricted by external regulations (e.g. church, registry office), CUBU PHOTOGRAPHY GMBH is not liable for missed shots.

9. Rescheduling

If the couple reschedules, a rebooking fee of CHF 500.– is due. A new date must be agreed upon. Otherwise, the deposit will be forfeited.

10. Photographic style

The couple acknowledges the style of CUBU PHOTOGRAPHY GMBH. Variations due to lighting conditions, locations or weather do not constitute a defect.

11. Data backup

After receiving the final images, the couple is responsible for backing them up. CUBU PHOTOGRAPHY GMBH archives the photos for 12 months and offers support in the event of data loss within this period.

12. Copyright and usage

All copyright and other intellectual property rights in the photographs, videos and other works produced by CuBu Photography GmbH remain exclusively with CuBu Photography GmbH, unless expressly agreed otherwise in writing.

Upon full payment, the client receives a simple, non-exclusive, non-transferable, and perpetual right of use for the private use of the delivered images and videos.

Any commercial use, publication, or use of the recordings by third parties – in particular companies, hotels, venues, wedding service providers, agencies, or other commercial organizations – requires the prior written consent of CuBu Photography GmbH and may be subject to the payment of an appropriate license fee.

The transfer of the images to third parties for the purposes of commercial use or advertising does not confer any rights of use upon those third parties.

CuBu Photography GmbH is entitled to claim the standard licence fee, as well as any further legal claims under the applicable copyright law, in the event of use without the requisite consent.

The personal rights of the persons depicted remain unaffected by this provision.

13. Delivery time

The editing time is 10 to a maximum of 12 weeks from the wedding date. Complaints must be made within 7 days of image delivery.

14. Backup equipment

CUBU PHOTOGRAPHY GMBH always brings a backup camera as well as spare lenses.

15. Liability

CUBU PHOTOGRAPHY GMBH is only liable for intentional or grossly negligent conduct. No liability is assumed for failures due to force majeure (e.g. illness, accident, natural events).

16. Replacement photographer in an emergency

In the event of cancellation due to illness or force majeure, CUBU PHOTOGRAPHY GMBH will endeavour to provide an equivalent replacement. If this is not possible, the deposit will be refunded in full. Any further claims for damages are excluded.

17. Catering

For reportages of 6 hours or more, the couple provides a simple meal and drinks.

18. Travel costs

Travel within 20 km from Hinwil is included. Beyond that, CHF 0.70.- per kilometre will be charged. For longer journeys or destination weddings, accommodation and expenses will be agreed individually.

19. Weather conditions

CUBU PHOTOGRAPHY GMBH assumes no responsibility for weather-related limitations. Creative alternatives will be implemented where possible.

20. Guests and privacy

The couple informs their guests in advance about the photographic coverage. No compromising or inappropriate images will be published.

21. Use of drones

Drones are only used when weather conditions are suitable, legal approval is in place, and sufficient safety is ensured. Restrictions by third parties do not limit the obligation to perform.

22. Selection and RAW files

The selection of images to be edited is made by CUBU PHOTOGRAPHY GMBH. Raw data (RAW files) will not be handed over; this also applies to the film footage.

23. Social media tagging

When using the images on social media, CUBU PHOTOGRAPHY GMBH requests tagging or credit. Editing with filters or changes to the style are not permitted.

24. Break policy

For bookings over 6 hours, CUBU PHOTOGRAPHY GMBH is entitled to a 30-minute break. This will be sensibly scheduled into the day.

25. Additional services on the wedding day

Spontaneous extensions of reportage time on site will be charged at CHF 660.- per hour and require verbal consent on site.

26. Additional services (bookable in advance)

Further services such as after-wedding shoots or various print products can be booked individually. Prices can be found in the current offer.

27. Validity of the Terms and Conditions

These Terms and Conditions are deemed accepted upon signing the contract. The German version is authoritative.
